This agreement is between Phillip Haumesser Photography LLC (PHP) and CLIENT.

1. Scope of Work: 

This contract is for services and products related to a photography shoot (hereafter “shoot”) to take place at the following time and place.

PHP and CLIENT are to arrive for the SHOOT at DATE at LOCATION.

PHP agrees to provide no fewer than 10 images for CLIENT after the shoot. PHP will perform advanced post-processing or digital image editing services on these images where artistically necessary.

CLIENT can choose which 10 images they want, but CLIENT must choose within 48 hours of receiving the link for choosing the images. If CLIENT does not choose their 10 images within 48 hours of receiving the link, PHP will choose them.

The full session includes 10 retouched images, but CLIENT can choose extra images for $12.50 per extra image.

The full session is for 1-5 persons. If CLIENT would like to have more persons in the session it is $15 per extra person. 

2. Fees: 

In consideration for the SHOOT provided by PHP, CLIENT agrees to pay the sum of $125. CLIENT agrees to pay the photographer a non-refundable initial fee totaling $50 upon signing this contract. If CLIENT cancels this SHOOT for any reason, the initial fee will not be returned to CLIENT.

Payment must be made in full for the SHOOT prior to delivery of any images. 

3. Work Product 

PHP will deliver images to CLIENT in the form of a disc or download link no more than thirty days (30 days) after the date of the SHOOT. PHP is not obligated to, and will not provide the RAW files to the CLIENT.

All images delivered to CLIENT are CLIENT’S property except PHP is licensed to use any image for it’s business marketing. 

4. Indemnification: 

4.1. – PHP and CLIENT agree that PHP is under no obligation to capture any specific moment or pose or person(s) during the SHOOT.

4.2. – PHP liability is limited to only a refund to CLIENT of all monies paid to PHP, including the nun-refundable deposit.

4.3. – CLIENT agrees to hold PHP harmless for any personal injury which may occur as the CLIENT poses or works with PHP. The ClIENT is responsible to tell PHP if they are uncomfortable with a certain pose or situation.

5. Duty of Client 

CLIENT will obtain all permissions necessary for PHP to photograph at the SHOOT.

PHP has no duty to obtain permission of reception centers, churches, buildings, properties, or other locations to operate thereon. CLIENT understands and agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of photographer.
